Como a maioria dos meus leitores sabe, eu publiquei, entre 1996 e 2002 18 livros pela editora Axcel Books. O que poucos sabem é que desde 2002 não recebo um só tostão pelos livros que escrevi, sendo este o motivo pelo qual eu não lancei novos livros nem atualizei os meus livros já lançados.
As most of you know, I had 18 books published by Axcel Books between 1996 and 2002. (The owners are called Ricardo Reinprecht and Gisella Narcisi Reinprecht.) What most of you don't know is that since 2002 I don't receive a penny for them, and that is why I haven't written or updated any book since then.
Esta postura da Axcel Books me fez ficar completamente desestimulado para escrever novos livros. No mundo todo, a forma de remuneração de um autor sobre um livro escrito é uma porcentagem sobre as vendas, chamada royalty. Basta pegar um tijolo como o Hardware Curso Completo (que tem 1.440 páginas) para tentar entender o trabalhão que me dá escrever um livro e ainda coordenar as ilustrações: é coisa para seis meses de trabalho escrevendo de 8 a 12 horas por dia. E isso usando as demais horas do dia escrevendo artigos para o site, colunas para jornal (na época) e ainda tentando levar uma vida normal – pelo menos nos fins de semana. Essa trabalheira toda compensa? Compensaria, se a Axcel Books fizesse a sua contra-parte: me pagar.
Para complicar a situação, meus contratos com esta editora impediam que eu mudasse de editora e que eu republicasse meus livros com outra empresa. Eu estava de mãos atadas!
This issue made me completely disheartened to write new books. The way authors make money is through royalties, a small percentage of the proceeds from the books' sales. If you see my #1 best selling book, Hardware Curso Completo ("Hardware Complete Course"), with its 1,440 pages, you quickly realize how hard it is to write a book and coordinate the production of the illustrations: it takes about six months working eight to twelve hours per day. I still used the remaining hours of my day for writing articles for this website, columns for the newspaper I contributed at the time, and trying to live a normal life, at least during the weekends. Is all this work worthwhile? Well, it would be, if Axcel Books did their part: pay me. To make things more complicated, the contracts I had with this company prevented me from swtiching to another publishing house and that I republished my books with another company. I had my hands tied!
Por estes motivos, no início de 2003 eu e a Axcel Books iniciamos uma batalha judicial. De um lado a Axcel dizia que era boa pagadora e que não estava devendo nada e queria me obrigar a escrever dois novos livros que eu já tinha contratos assinados (para constar, Segurança Curso Completo e Alavancando Negócios na Internet 2ª edição) – sendo que os contratos já estavam vencidos, isto é, eu não estava obrigado a entregar nada. Do meu lado eu só queria o óbvio: ser pago, ser liberado para publicar livros por qual editora eu bem entendesse e retomar os direitos autorais dos meus livros já publicados, isto é, atualizá-los e reeditá-los por outra editora.
For all those reasons, in the beginning of 2003 me and Axcel Books started a legal battle. At one side, Axcel Books claimed that it was a good payer, that they were not owing me any money, and they wanted to force me to write to new books that we had the contracts already signed. However, these contracts were already expired, i.e. I wasn't obliged to anything. At the other side, I just wanted the obvious: to be paid, to be free to have my books published by another company, and take back the rights to my published books, so I could update and re-publish them through another publishing house.
Nesse meio tempo, a Axcel fez tudo o que pode para enrolar o andamento do processo. A parte mais crítica era apurar o quanto eles estavam me devendo, pois a partir do momento em que eles deixaram de me pagar, eles também deixaram de prestar contas de quantos livros eram vendidos e o quanto eles estavam me devendo. Eles se recusaram a cooperar com o perito contábil apontado pelo juiz. Por este motivo o perito, por ordem do juiz, muito sabiamente fez uma conta simples, pegou os períodos para os quais eu tinha os relatórios de prestação de contas, fizeram uma média de quanto eu recebia por mês e multiplicaram pelo número de meses que eles estão sem prestar contas. A soma deu um valor substancial.
Meanwhile, Axcel Books made everything it could to delay the law suit. The most critical part was to discover how much they were owing me, as from the date they stopped paying me, they also stopped sending me the sales reports. The company refused to cooperate with the court-appointed auditor. For this reason, the auditor, following instructions given by the judge, cleverly made a simple math: he took the average amout I received in royalties during the period I had the reports for and then multiplied this number by the number of months they didn't provide sales reports for. This totalled to a very substantial amount.
Finalmente no dia 1º de março de 2007 foi publicada no diário oficial a sentença do processo, favorável a mim, cancelando todos os 18 contratos que eu tinha com a Axcel Books, me devolvendo os direitos autorais de todos os meus livros, e obrigando a Axcel a pagar, com juros e correção monetária, o valor apurado pelo perito contábil.
Finally, on March 1st, 2007, the sentencing was published, ruling in my favor, cancelling all 18 contracts that I had with Axcel Books, giving all the books' rights back to me, and sentencing Axcel Books to pay me the amount calculated by the auditor, ajusted by inflation and with the legal-mandated interest.
A Axcel Books não recorreu desta sentença e no dia 3 de abril de 2007 o juízo autorizou a execução da dívida. Entretanto, quem já passou por um processo de cobrança sabe que existe uma enorme diferença entre ganhar e levar.
Axcel Books didn't appeal and on April 3rd, 2007, the judge authorized the execution of the sentence. However, as all those who have already gone through a debt collection lawsuit in Brazil knows, there is a big difference between winning and seeing the color of the money.
Por outro lado, estou com a alma lavada, pois atingimos o mais importante no dia 1º de março de 2007: o ganho moral. A partir da sentença publicada, tudo o que aconteceu passou a ser público, e posso divulgar sem problema de atrapalhar o andamento do processo, visto que não há mais processo. O mais importante é podermos divulgar publicamente o que estava acontecendo, o motivo pelo qual eu não estava mais publicando novos livros e atualizando meus livros antigos, e alertar a todos, em particular autores e aqueles que pretendem um dia escrever um livro, sobre o que ocorre no mercado editorial brasileiro e estimular que todos os autores que se encontrem em situação similar que, não encontrando acordo com a editora, entrem com um processo, pois situações como essa não podem ficar impunes.
If I didn't have the monetary gain, at least I won morally. Since the sentence was published, all information becomes public and I finally can expose what has happened to me and the reason why I was not writing or updating books. Also, I hope my story will help hopeful authors to know what really happens in the Brazilian publishing market. And for those authors already published, if you are in the same situation and can't get your publishing to pay what they owe you, don't be afraid to sue them! People like this (Ricardo Reinprecht and Gisella Narcisi Reinprecht) should be exposed and stopped from swindling other people.
Essa é apenas a primeira batalha. No momento ainda estou pensando no que fazer com a minha carreira de autor, visto que estou bastante desestimulado a continuar escrevendo livros, visto o ocorrido.
This is just the first battle. At this point in time, I am still debating what to do with my writing career, as I am pretty much disheartened because of this whole situation, as you may guess.
